If you lived in California (1998-2004) you are likely part of this MBNA credit card class action lawsuit filed against MBNA if you had one of their MBNA credit cards during this time. Seems that MBNA got a little bit greedy (this is the allegation) and they sold private information belonging to their credit card customers.
What is the MBNA credit card class action lawsuit about? Plaintiffs claim that defendants MBNA America Bank, N.A., MBNA Corporation, and MBNA Marketing Systems, Inc. ("Defendants") improperly: (1) sold and/or disclosed their customers’ personal information to third parties; (2) used their customers’ personal information for or in Defendants’ own marketing; and (3) represented the scope and nature of their customer privacy policy.
Plaintiffs allege that this use and these sales and/or disclosures violated California law and any MBNA privacy policies. Plaintiffs seek injunctive relief, restitution, disgorgement of profits, imposition of a constructive trust, compensatory damages, punitive damages and attorney fees and costs.
Defendants deny Plaintiffs’ allegations and any wrongdoing. Defendants contend that they fully complied with their privacy policy, cardholder agreements and applicable law, and that Plaintiffs’ contentions are without merit. The Court has not made a determination about the strengths or weaknesses of either Plaintiffs’ or Defendants’ contentions concerning the merits of this case.
2. How do I know if I’m a MBNA credit card class member? The class in the lawsuit includes any person who between June 4, 1998 and September 15, 2004: (1) held a MBNA credit card issued by MBNA America Bank, N.A., MBNA Corporation, or MBNA Marketing Systems, Inc.; (2) had a California mailing address for purposes of communicating with MBNA; and (3) at the time that they had that California mailing address, had personal financial information about them disclosed by MBNA to any third-party vendor with whom MBNA has or had a contract, agreement or understanding to disclose certain customer information and pursuant to which MBNA was entitled to receive money, directly or indirectly, as a result of any sales of goods, programs or services by the third party vendors to MBNA credit card holders or through an administrative, service or transaction fee.
Excluded from the MBNA Class is MBNA, any parent, subsidiary or affiliate of MBNA, and all officers and directors who are or have been employed by MBNA at any time from June 4, 1998 to September 15, 2004. If you meet this description, you are automatically a member of the class.
